Terms of service.

1. Who we are

lystners is a service operated by Vivanet Consultancy Services Pvt Ltd, a private limited company incorporated in India (PAN AAICV6716F, GSTIN 27AAICV6716F1Z4), with its registered office at G-306, Rohan Kritika, Sinhagad Road, Pune, Maharashtra 411030, India. In these Terms, "lystners", "we", "us", and "our" refer to this entity.

2. What lystners is — and what it isn't

lystners is a peer-support and emotional-wellness platform that offers anonymous community shares, optional 1:1 counsellor sessions, asynchronous voice threads with counsellors, and a private journal. It is intended to help you reflect, process, and connect with others who may be going through similar things.

lystners is not a medical service. We do not provide diagnosis, psychotherapy, psychiatric care, or any form of medical treatment. Counsellors on the platform offer emotional support and guidance, but they do not establish a doctor-patient relationship with you. Nothing onlystners should be considered a substitute for advice, diagnosis, or treatment from a qualified mental-health professional or medical practitioner.

3. Eligibility

You must be at least 18 years old to create an account. If local law in your jurisdiction sets a higher age of digital consent, you must meet that age. By signing up, you confirm that you meet these requirements.

4. Your account

You create an account using a pseudonym and a password, with an optional recovery email. You are responsible for keeping your credentials confidential and for everything that happens under your account. If you set a private journal passphrase, please note that we cannot recover it for you — by design, it never leaves your device.

5. Subscription, pricing, and renewal

Access to lystners requires an active annual subscription. Pricing is shown on our Pricing page: ₹199 per year for users in India and US$10 per year for users in other countries. The currency that applies to your account is determined at signup based on your declared country of residence and is locked for the life of your subscription.

Subscriptions renew automatically each year through Razorpay using the payment method you provided. You will continue to be charged annually until you cancel. You can cancel auto-renewal at any time from your account page; cancellation stops the next renewal but does not refund the current period — you keep access until the end of the period for which you have already paid, after which your account lapses.

We may change subscription pricing from time to time. Any change will apply at your next renewal, not within an active period, and we will give you at least 30 days' notice by email before the change takes effect.

6. Counsellor sessions

Counsellor sessions are booked separately from the subscription at prices set by individual counsellors and shown to you before booking. The fee is charged at the time of booking. Counsellors are independent professionals, not employees of Vivanet Consultancy Services Pvt Ltd. We verify their credentials, provide the platform on which sessions take place, and handle payments and refunds — but the counselling relationship itself is between you and the counsellor.

Cancellations made at least 24 hours before the scheduled start time receive a full refund. Cancellations inside the 24-hour window are non-refundable. If you do not attend a scheduled session, no refund is due. If the counsellor does not attend, you receive a full refund. The full policy is on our Refund Policy page.

7. Voice threads

Each subscription includes a bundled monthly quota of asynchronous voice threads with counsellors. Once you exceed that quota, you can purchase additional threads or packs. Purchased voice-thread credits are non-refundable once paid for, including any unused credits remaining in a pack.

8. Acceptable use

You agree not to use lystners to:

• Harass, threaten, dox, or impersonate any person, including other members and counsellors
• Post content that promotes self-harm, suicide, eating disorders, or violence; share illegal content; or share sexually explicit material
• Solicit, advertise, recruit, or sell anything (including counselling services outside the platform)
• Attempt to access another user's account, scrape the service, or interfere with its operation
• Use the platform in any way that violates applicable law, including the laws of India

Content you submit passes through an automated moderation pipeline, and we may also review reports submitted by other users. We may remove content, suspend, or terminate accounts that violate these rules.

9. Your content

You retain ownership of the content you submit (shares, comments, voice notes, journal entries, etc.). You grant Vivanet Consultancy Services Pvt Ltd a worldwide, non-exclusive, royalty-free licence to host, transmit, and display your content solely to operate the service. This licence ends when you delete the content, except to the extent that other users have already interacted with it (in which case those interactions may remain) or where retention is required by law.

Your private journal is encrypted on your device before it reaches us — we cannot read it, and counsellors cannot access it. See the Privacy Policy for details.

10. Privacy

Our Privacy Policy explains what data we collect, how we use it, who we share it with, and your rights under the Digital Personal Data Protection Act, 2023 and other applicable laws. By usinglystners, you also agree to that policy.

11. Disclaimers

The platform is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or secure, that any information on the platform is accurate or complete, or that interactions with counsellors or other members will produce any particular outcome.

Nothing on lystners constitutes medical advice. Always consult a qualified professional for medical or psychiatric concerns.

12. Limitation of liability

To the maximum extent permitted by law, Vivanet Consultancy Services Pvt Ltd, its directors, employees, and affiliates will not be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of profits, data, goodwill, or other intangible losses, arising from your use of (or inability to use) the platform. Our aggregate liability for any claim arising out of or relating to these Terms or the service will not exceed the amounts you paid us in the twelve months preceding the event giving rise to the claim, or ₹5,000 (whichever is greater).

13. Indemnification

You agree to indemnify and hold harmless Vivanet Consultancy Services Pvt Ltd and its personnel from any claim, demand, or damages (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the service, or your violation of the rights of any third party.

14. Termination

You can stop using lystners at any time. You can also delete your account from the account deletion page; deletion is processed in line with our Privacy Policy and may not be reversible.

We may suspend or terminate your account, with or without notice, if you breach these Terms, if your payment fails and is not cured within the grace period, or if continued provision of the service to you is, in our reasonable judgement, unsafe or unlawful.

15. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified to you by email (if you have provided one) and announced on the service at least 14 days before they take effect. Your continued use after the effective date constitutes acceptance.

16. Governing law and jurisdiction

These Terms are governed by the laws of the Republic of India, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the service will be subject to the exclusive jurisdiction of the courts of Pune, Maharashtra, India.
